These Terms of Service ("Terms") govern your use of the Avina app and website operated by Avina Insights, LLC ("Avina," "we," "us," "our"). By using the Service, you agree to these Terms.

1. What Avina is

Avina is an AI-powered productivity and wellness planner that adapts daily recommendations to where you are in your menstrual cycle. Avina is not a medical device or service. It does not diagnose, treat, cure, or prevent any disease or condition. It is not intended for use as a contraception method, fertility tracking tool, or pregnancy detection tool.

Avina provides educational guidance only, based on commonly cited patterns in hormonal cycle research. Individual variation is significant, and Avina's recommendations should not replace advice from a qualified healthcare provider.

2. Eligibility

You must be 18 years or older to use Avina. By creating an account, you confirm that you are at least 18.

3. Account registration

To use most features, you must create an account. You agree to provide accurate information and to keep your account credentials secure. You are responsible for activity that occurs under your account.

4. Subscriptions and billing

Avina offers a free tier and a paid Premium subscription.

Premium subscription. Premium is billed annually in advance at the price displayed at checkout (currently $59.99/year, subject to change with notice). Your subscription automatically renews each year on the anniversary of your purchase, charged to your saved payment method, unless you cancel before renewal.

Cancellation. You may cancel anytime through Avina's customer billing portal or by emailing support@avinaapp.com. Cancellation takes effect at the end of your current billing period; you retain access until that date.

Refunds. All payments are non-refundable except as required by applicable law. If you experience a billing issue, contact us at support@avinaapp.com and we'll work to resolve it fairly.

Price changes. We may change Premium pricing for future renewal periods with at least 30 days' notice. Changes do not affect your current paid period.

Promotional codes. Promotional codes — including founding member pricing — are subject to their own terms shown at the time of redemption.

5. Acceptable use

You agree not to:

Use the Service for any unlawful purpose
Attempt to access another user's account
Reverse engineer, decompile, or attempt to extract source code
Use automated systems to access the Service except as explicitly permitted
Send abusive or threatening content through the AI chat
Interfere with the Service's operation
Resell or commercially exploit the Service without our written permission

We may suspend or terminate your account for violations of these Terms.

6. Your content

You retain ownership of content you submit to Avina (tasks, wellness logs, chat messages, etc.). You grant Avina a limited license to use that content solely to provide the Service to you, including to personalize your experience.

We do not use your personal content to train AI models for other users or for third parties.

7. AI-generated content

Avina uses AI to generate recommendations, schedules, insights, and chat responses. AI-generated content is provided as educational guidance and may contain inaccuracies. You are responsible for decisions you make based on AI suggestions. Avina is not liable for outcomes resulting from following AI-generated recommendations.

8. Medical disclaimer

Avina is not a medical service. The cycle-related content, recommendations, and insights provided by Avina are for educational and productivity guidance only.

Do not use Avina to diagnose, treat, cure, or prevent any disease.
Do not rely on Avina for contraception, fertility planning, or pregnancy detection.
Always consult a qualified healthcare professional regarding medical questions or concerns.
If you experience symptoms that worry you, contact a healthcare provider.

9. Avina's intellectual property

The Service, including its design, software, content, trademarks, and branding, is owned by Avina Insights, LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI RECOMMENDATIONS WILL BE ACCURATE OR APPROPRIATE FOR YOUR SITUATION.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AVINA INSIGHTS, LLC AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, ARISING OUT OF YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold Avina Insights, LLC harmless from claims arising out of your use of the Service in violation of these Terms or applicable law.

13. Termination

You may stop using the Service and delete your account at any time. We may terminate or suspend your account if you violate these Terms or for other legitimate reasons. Upon termination, your right to use the Service immediately ceases.

14. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any disputes will be resolved in the courts located in Texas.

15. Changes to these Terms

We may update these Terms from time to time. We'll update the "Last updated" date and, for material changes, notify you through the Service or by email. Continued use after changes constitutes acceptance.
